The Spanish Arbitration Act 2003, as amended by the Act of 2011, solved the shortcomings of the previous 1988 Act and harmonised the legal regime of arbitration, thus encouraging the practice and providing businesses with greater certainty about the content of the legal regime of arbitration in Spain.

The Act was based on the Model Law developed by the United Nations Commission for International Trade Law, of 21st June 1985 (UNCITRAL Model Law / UNCITRAL), which reflects a compromise between the continental European and Anglo-American legal traditions.
