Emergency Arbitrator

On 3rd June 2014 the Board of Directors of the Associació Catalana per a l'Arbitratge unanimously approved the regulation of the emergency arbitrator.

With this regulation, the TAB joints the trend followed by other arbitral institutions of international and national ambit in order to respond to the need of parties to conflicts who, faced with this decision-making void in the pre-arbitral stage of the arbitral procedure, would be forced for reasons of urgency to resort to the state courts for precautionary measures to protect the outcome or the arbitration process itself.

The emergency arbitrator shall act only in the process for adoption of precautionary measures which cannot wait until the arbitration tribunal (Trial Arbitrator) is appointed.


  • Coming into effect: These rules shall come into effect on 1st September 2014, provided that two months have passed since publication on the Tribunal Arbitral de Barcelona (Barcelona Arbitration Court) corporate website, www.tab.es.
